Terms and Conditions of Krungsri Business Link

  • Krungsri Business Link is a service rendered by Bank of Ayudhya Public Company Limited (“Bank”) to provide convenience to a User (“User”) with the objectives to allow the User to:
    • post information related to the User’s goods or services on the Bank’s website;
    • search or view the goods or services posted on the Bank’s website;
    • exchange information or communicate with other users of Krungsri Business Link through channels provided by the Bank;
    • participate in the Bank’s marketing promotional campaigns;
    • use other services as further provided by the Bank.
  • The User must be a juristic person who possesses qualifications determined by the Bank. In case the User has never used any of the Bank’s financial product before, the User is required to apply for the use of at least 1 (one) financial product for corporate customers, e.g., business loans or cash management services within 1 (one) year from the date the User registered to use Krungsri Business Link.
  • The User shall register for Krungsri Business Link account by providing an accurate and complete information on the Bank’s website. The User can create only 1 (one) main account and may later create any other persons to be a system administrator(s) and other user(s) according to rules determined by the Bank. Such system administrators and other users can perform all functions in Krungsri Business Link, except for creation, removal, and change of access rights of the system administrators and other users, which can only be performed by the User and system administrators.
  • The User represents that the information imported into the system of the Bank:
    • is accurate, true and up-to-date;
    • is the information owned by the User or the information in which the User has proprietary right or other rights under the laws, or the information which the User is lawfully permitted to use.
    If the Bank discovers that the User’s information is not consistent with any of the above representations, the Bank reserves the right to immediately reject or suspend the provision of service to the User.
  • In using Krungsri Business Link, the User agrees and acknowledges that:
    • the User shall procure, install and maintain computers and equipment within the User’s computer system, and shall integrate the same to the Bank’s system in order to transmit the information through the internet network in accordance with the procedures, methods and standards specified by the Bank, the costs of which shall be borne by the User;
    • the User shall keep user ID and password, as well as any other access codes, confidential and shall not disclose the same to any persons. The User further undertakes to ensure that the system administrators and other users keep such user ID, password or code confidential for the benefit of the User. If the User believes that any unauthorized person has used the password to access the system, the User shall inform the Bank immediately;
    • if the User has entered incorrect password for more than the number of times specified by the Bank, the User will not be allowed to use Krungsri Business Link until the User proceeds according to the procedures and methods required by the Bank;
    • the User acknowledges that, where Krungsri Business Link can be accessed through the internet network using password, any action carried out using the said password shall be valid and binding on the User without the User’s signature on any document. The User also agrees to be responsible for such action as if it had been performed by the User regardless of who has performed such actions and for whatsoever reasons except in case of fraud which the User has not colluded or been involved in the cause of such act, and the User agrees that the information processed and displayed in the Bank’s system shall be relied on without the Bank’s verification of accuracy of the source information and/or authority of the User;
    • the User agrees that the Bank shall have the right to determine features and functions of Krungsri Business Link;
    • the User agrees to be solely responsible for texts, images, videos, computer codes or any other information that the User posted on, uploaded or imported into the Bank’s system (“Content”) and the Bank shall have no obligation to verify the accuracy, completness, up-to-dateness or lawfulness of the Content. If any Content causes damage to the Bank or any third party, the User agrees to be liable for such damage in the actual amount incurred;
    • The User represents that the Content and/or any information imported or uploaded by the User into the Bank’s system is free of computer virus or any other item which may harm the Bank’s computer system. If the Bank has sufferred any damage due to computer virus or any item that is harmful to the computer system, the User agrees to be responsible for damages incurred by the Bank.
  • The User shall examine, correct and maintain the Content or the information imported into the Bank’s system to ensure that the same is accurate, complete and up-to-date at all times.
  • The User agrees and consents that the Bank may disclose the User’s information, Content and/or details of goods or services posted by the User on Krungsri Business Link to other users of Krungsri Business Link. In this regard, the User acknowledges that the Bank may examine, amend, or delete the User’s information including the Content and/or details of goods or services, or suspend or terminate the use of this service, where the Bank’s decision shall be final.
  • The User agrees and acknowledges that the User shall use Krungsri Business Link for lawful purposes and shall not:
    • offer any goods or service which is illegal or may instigate disunity or disharmony among the public or raise political issue, or is in contrary to good morals or may lead to detriment of national culture, or violates the Bank’s rules and procedures;
    • offer goods or services related to gambling, all kinds of alcohol beverages and cigarettes;
    • offer counterfeit, replicated, reproduced, modified or imitated goods, whether in whole or in part, or present or offer any information obtained from sources or other websites which are not operated by the User without permission from the owner;
    • use any impolite, inappropriate, provocative, or obscene languages;
    • display, use or distribute information which are false, exaggerated, or deceitful, or information violating other person’s rights or reputation, or statement that is ambiguous or may cause material misunderstanding of the goods or services, or statement which cannot be true;
    • display or use any national symbol, royal photograph or portrait of His Majesty the King, Her Majesty the Queen and other members of the Royal Family or symbols of government agencies;
    • commit any act which violates the intellectual property right of other persons or the Bank.
  • Krungsri Business Link is provided solely to facilitate the User in offering goods or services of the User and receiving information related to the goods or services offered by other users of Krungsri Business Link. The Bank will not involve in any way in any information of the User, as well as the Content and/or goods or services posted or offered by the User or other users of Krungsri Business Link on the Bank’s website, or any other information which the User may receive using this service.
  • The User acknowledges that the Bank will not involve in warranties, prices, features or quality of the goods or services, as well as fees, charges or any terms and conditions posted or offered by the User or other users of Krungsri Business Link through the Bank’s website. The User shall contact such other users of Krungsri Business Link directly for information, negotiation or execution of transaction and shall examine the features of the goods or services, as well as qualifications of the person with whom the User will enter into the transaction. In this regard, the Bank will not involve in any communication, performance or transaction which has taken place. In case of dispute, the User shall assert its claim against such person directly.
  • The User agrees to carefully use the service and shall preserve the Bank’s reputation. In case of dispute between the User and other persons arising from the use of this service, the User shall endeavor to resolve such dispute without delay to prevent any potential damage to the Bank. In addition, the User shall not do any act which may result in the Bank being involved in such dispute.
  • The User acknowledges that the Content on the Bank’s website may contain information or link to the websites or application of the User or other users of Krungsri Business Link. The User acknowledges and agrees that such information is beyond the Bank’s control and the Bank is under no obligation to verify or be responsible for the Content, safety, completion, accuracy, or protection of personal data of such websites or applications.
  • In the case where the User requests the Bank to deliver messages to the User through various channels, such as SMS or email, which the User has registered with the Bank when signing up for this service or as subsequently updated, for the purpose of notifying the User of service-related information, such as notification of messages received from other users, or delivery of commercial information, e.g., benefits related to Krungsri Business Link or information pertaining to other products/services of the Bank. The User must exercise caution in observing details and sources of the information received before clicking on links or scanning QR codes each time. The User acknowledges that the User may configure settings to opt out of receiving such information through Krungsri Business Link system at any time.
  • The User consents the Bank to disclose, exchange with, transmit, and/or transfer personal information related to the User or any other information provided by the User to the Bank for the purpose of applying for Krungsri Business Link or in the course of using the service to the Bank’s financial business group, data processors, third-party service providers, agents, subcontractors, and/or co-branding business partners, where it is necessary for the Bank to disclose such information in order to enable the Bank to provide Krungsri Business Link service; as well as for the purpose of performing risk assessment on the User; for the purpose of preventing or detecting fraud and investigating potential fraudulent transactions; for the purpose of improving the Bank’s services or products; for the purpose of analyzing and developing financial services of the Bank and the Bank’s financial business group; for the purpose of communicating with the User regarding the service; for the purpose of supporting the Bank’s service operation; for the benefit of debt collection process; and for the benefit of data processing.
  • The User acknowledges that the Bank may suspend or terminate the provision of this service in case the provision of service by the Bank violates provision of laws or regulations or the rules and procedures set out by the Bank; or the User has breached any terms and conditions imposed by the Bank; or the User is subject to legal proceedings; or in case the Bank has notified the User of transaction disruption prior to or at the time of transaction; or in case the Bank’s system, computer, equipment, telecommunication system, network and/or internet system program is damaged, malfunctions, under repair or temporarily closed for maintenance; or in case of force majeure which has prevented the User from carrying out the transaction via the Bank’s website; or in case the Bank has not received the information or is unable to proceed according to the information uploaded into the Bank’s website by the User. In this regard, the User shall not raise such circumstances to make a claim for liability against the Bank.
  • The User acknowledges and agrees that the Bank shall have the right to amend the Terms and Conditions of Krungsri Business Link, including service charges and fees (if any) by notifying the User with a 15 (fifteen) days’ advance notice via the Bank’s appropriate communication channels (e.g. a notice posted on the Bank’s website or in the Bank’s places of business and/or via other channels). To the extent necessary for preventing fraud or rectifying any default on payments or breach of any agreements or terms and conditions with the Bank, the Bank may later provide the User with notice of such changes or such course of action within a reasonable period of time. In this regard, the User may terminate this service if any such amendment has resulted in an increase in expense or burden borne by the User.
  • The Bank may at any time change, add or remove features and functionalities of the services or terminate the whole service. If the Bank makes change that negatively impact the use of the service, the Bank will provide the User with a 15 (fifteen) days’ advance notice via the Bank’s appropriate communication channels (e.g. a notice posted on the bank’s website or in the bank’s places of business or via other channels). To the extent necessary for preventing fraud or rectifying any default on payments or breach of any agreements or terms and conditions with the bank, the bank may later provide the User with notice of such changes or such course of action within a reasonable period of time. In this regard, the User acknowledges that the Bank shall have the right to terminate the service of Krungsri Business Link immediately in case the User breaches any Terms or Conditions herein where such termination shall not prejudice the right of the Bank to claim for damages arising out of such breach by the User.
  • Where the User has provided to the Bank personal data of any other person other than the Bank:
    • the User undertakes to verify the accuracy and completeness of such persons’ personal data provided by the User to the Bank, and to notify the Bank of any change to the personal data provided;
    • the User warrants that the User has obtained consent or can rely on other legal basis for the collection, use, disclosure and/or transfer of such personal data in compliance with applicable laws;
    • the User warrants that the User has informed such person of the Bank’s privacy notice; and
    • the User warrants that the Bank can lawfully collect, use, and further disclose and/or transfer such personal data for the purposes set out in the Bank’s privacy notice (as may be amended from time to time), including the purposes set out in this Terms and Conditions.
  • The User agrees that these Terms and Conditions shall be construed and interpreted in accordance with the laws of Thailand.
